Terms and Conditions

• "App" refers to the Ander Baher™ mobile application and any associated web platforms, dashboards, and related services made available in connection with attendance operations (including the "AB Attendance Manager").
• "Services" refers to the attendance management, attendance regularisation, geofencing, identity verification, reporting, and related workforce attendance services provided through the App.
• "User" means any employee, contractor, staff member, or other individual authorised by an organisation using the App to use it for attendance-related purposes.
• "Manager" refers to designated personnel, supervisors, administrators, or other authorised representatives of an organisation using the App who may review, approve, reject, or manage attendance-related records.
• "Biometric Data" refers to the facial images and feature templates used for identity verification.

The App is designed to assist organisations in tracking workforce attendance using:

1. Facial Recognition: To verify the identity of the User during punch-in and punch-out.
2. Geofencing: To verify that the User is present at an authorised work location (Site or Office) during the punch action.
3. Attendance Review and Regularisation Workflows: To facilitate attendance corrections, supporting evidence review, and approval workflows that may be enabled by your organisation.

To use the App, You must be registered by your employer or administrator. You agree to:

• Provide accurate, current, and complete information during registration (Name, Email, Phone Number, Gender, DOB).
• Maintain the confidentiality of your login credentials, including any one-time passwords (OTPs) or similar verification credentials used to access the App.
• Notify Us immediately of any unauthorised use of your account.
• Prohibition on Account Sharing: You shall not allow any other individual to use your account to mark attendance. "Proxy" attendance is strictly prohibited and constitutes a material breach of these Terms.

• Accuracy: You acknowledge that your attendance is recorded based on the precise time and location data captured by your device at the moment of the punch.
• Location: The App accesses your precise location to verify attendance at authorised work locations. On supported devices and where enabled by your organisation, the App may also access your location in the background during an active attendance session after Punch In. This is used only for attendance-related validation, work-radius checks, and audit records, and is intended to stop when the active attendance session ends.
• Missing Punch Alerts: The App may alert You of missing attendance logs ("Missing Punch"). It is Your responsibility to regularize these entries promptly.
• Regularisation Approval: All regularisation requests (correcting past dates, modifying times) are subject to approval by your designated Manager. The Company is not liable for loss of pay or disputes arising from rejected regularisation requests.
• Shift Timings: Punches marked outside of assigned shift timings (e.g., late entries) may be flagged for Manager approval.

You agree not to:

1. Use any "mock location" applications, GPS spoofing tools, or emulators to falsify your location.
2. Attempt to bypass facial recognition using photographs, videos, or masks.
3. Reverse engineer, decompile, or disassemble the App.
4. Use the App for any illegal purpose or in violation of any local, state, national, or international law.
5. Harass, threaten, or defame any other User or Company employee through the App.

The App, including its source code, design, text, graphics, and logos (excluding User-generated content), is the exclusive property of Interext Technologies Pvt. Ltd. and is protected by Indian copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to use the App solely for your internal business or employment purposes.

Your use of the App is also governed by our Privacy Policy. By using the App, You consent to the collection and use of your information, including Biometric Data and Location Data, as detailed in the Privacy Policy.

• Termination by Company: We may suspend or terminate your access to the App immediately, without prior notice, if you breach these Terms (e.g., falsifying attendance).
• Termination by User: You may request account deletion by contacting care@anderbaher.com or through any account deletion request form that we or your organisation may make available.
• Data Retention Policy: Upon a verified account deletion request, we will delete or de-identify your Profile Information and registered face profile data from our active systems, subject to reasonable backup cycles and any legal obligations. However, You explicitly agree that official attendance records and related business records, including Attendance Logs, punch-related Location History, attendance regularisation records, manager/user remarks, and supporting evidence or attachments associated with attendance records, may be archived and retained by the Company and/or your organisation where necessary for payroll processing, fraud prevention, dispute resolution, audit, legal compliance, and employment history verification.

To the maximum extent permitted by law, Interext Technologies Pvt. Ltd. shall not be liable for:

1. Any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data.
2. Any failure or delay in the App due to causes beyond our reasonable control (e.g., internet failure, GPS signal loss, device malfunction).
3. Errors in salary calculation resulting from incorrect or unapproved attendance data.

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that the Geofencing or Facial Recognition technology will be 100% accurate at all times due to hardware limitations of your device.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka, India.

The Company reserves the right, at its sole discretion, to modify or replace these Terms at any time. Any changes to the Terms will be effective immediately upon posting the revised Terms on the Website. It is Your responsibility to review these Terms periodically for any changes. By continuing to access or use the Service after the revised Terms have been posted, You agree to be bound by the updated Terms. If You do not agree to the new Terms, You must stop using the Service.
